{"id":13986,"date":"2024-07-02T15:14:32","date_gmt":"2024-07-02T14:14:32","guid":{"rendered":"https:\/\/maritimafrica.com\/en\/?p=13986"},"modified":"2024-07-02T15:14:42","modified_gmt":"2024-07-02T14:14:42","slug":"itf-fights-for-labour-rights-at-the-international-labour-conference","status":"publish","type":"post","link":"https:\/\/maritimafrica.com\/en\/itf-fights-for-labour-rights-at-the-international-labour-conference\/","title":{"rendered":"ITF FIGHTS FOR LABOUR RIGHTS AT THE INTERNATIONAL LABOUR CONFERENCE"},"content":{"rendered":"<figure id=\"attachment_13987\" aria-describedby=\"caption-attachment-13987\" style=\"width: 800px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2024\/07\/53789174113_d3e2ff88be_o.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-13987 size-full\" src=\"https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2024\/07\/53789174113_d3e2ff88be_o.jpg\" alt=\"\" width=\"800\" height=\"600\" srcset=\"https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2024\/07\/53789174113_d3e2ff88be_o.jpg 800w, https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2024\/07\/53789174113_d3e2ff88be_o-300x225.jpg 300w, https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2024\/07\/53789174113_d3e2ff88be_o-768x576.jpg 768w, https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2024\/07\/53789174113_d3e2ff88be_o-720x540.jpg 720w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><\/a><figcaption id=\"caption-attachment-13987\" class=\"wp-caption-text\">Image credit: Violaine Martin\/ILO<\/figcaption><\/figure>\n<p style=\"text-align: justify;\"><em><strong>The ITF joined trade union allies from around the world in Geneva to call for action on serious breaches of workers\u2019 rights\u00a0<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\">The International Transport Workers\u2019 Federation (ITF) was in Switzerland in June for the annual meeting of what\u2019s become known as the \u2018international parliament of labour\u2019 \u2013 the International Labour Organisation\u2019s (ILO)\u00a0<a href=\"https:\/\/www.ilo.org\/meetings-and-events\/international-labour-conference\">International Labour Conference<\/a>\u00a0(ILC).<\/p>\n<p style=\"text-align: justify;\">This key event in the global labour calendar brings together representatives from governments, trade unions and employers to establish, adopt, and monitor international labour standards and to set the policy agenda of the ILO.<\/p>\n<p style=\"text-align: justify;\">The ITF joined\u00a0a number of ITF-affiliated transport trade unions from across the world in Geneva, as well as fellow global union federations under the banner of the\u00a0<a href=\"https:\/\/www.global-unions.org\/?lang=en\">Council of Global Unions<\/a>\u00a0(CGU), currently chaired by UNI Global Union General Secretary,\u00a0<a href=\"https:\/\/uniglobalunion.org\/staff\/christy-hoffman\/\">Christy Hoffman<\/a>.<\/p>\n<p style=\"text-align: justify;\">ITF General Secretary\u00a0<strong>Stephen Cotton<\/strong>\u00a0addressed the Conference and called for unity in confronting the overlapping crises facing working people around the world.<\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\">\u201cGlobally we are facing converging economic, political, social and climate crises that are threatening working people and have the potential to exacerbate existing inequalities,\u201d he said.<\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\">\u201cWe are seeing a decent work shortage in transport and across the global economy &#8211; workplaces are becoming increasingly unsafe, employment increasingly precarious, standards of living are falling and workplace rights \u2013 including the fundamental right to strike and right to collective bargaining \u2013 are under attack.\u202fDemocracy around the world is being threatened \u2013 no social justice can exist in societies where there is a violation of basic human rights, which is why I want to put on record our full support for the\u00a0<\/span><a href=\"https:\/\/social-justice-coalition.ilo.org\/\"><span lang=\"EN-US\" xml:lang=\"EN-US\">Global Coalition on Social Justice<\/span><\/a><span lang=\"EN-US\" xml:lang=\"EN-US\">.<\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\">\u201cTogether, we have a collective responsibility to respond to these crises \u2013 to build better workplaces and ensure inclusive and effective labour protection for all workers.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\">This year\u2019s Conference also took the initial step towards establishing the first-ever international labour standard governing biological hazards in the world of work. The ITF Legal Department\u2019s Helen Breese participated in the deliberations representing the voice of transport workers in these critical standard-setting negotiations.<\/p>\n<p style=\"text-align: justify;\">The below interventions were made at the \u2018<a href=\"https:\/\/www.ilo.org\/international-labour-standards\/ilo-supervisory-system-regular-supervision\/applying-and-promoting-international-labour-standards\/conference-committee-application-standards\">Conference Committee on the Application of Standards<\/a>\u2019, which examines whether or not ILO conventions are being properly applied, with governments given the opportunity to respond. The Committee makes recommendations on steps governments could take, or for technical assistance on the engagement of ILO missions.<\/p>\n<p style=\"text-align: justify;\">\n<h3 style=\"text-align: justify;\"><strong>Ecuador: Fishers among self-employed and informal workers without trade union rights<\/strong><\/h3>\n<p style=\"text-align: justify;\">The ITF explained to the Committee that self-employed and informal workers in Ecuador do not enjoy trade union rights under the country\u2019s Labour Code \u2013 a breach of ILO Convention 87 (<a href=\"https:\/\/normlex.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:12100:0::NO::P12100_INSTRUMENT_ID:312232\">C087<\/a>), Freedom of Association and Protection of the Right to Organise.<\/p>\n<p style=\"text-align: justify;\">In Ecuador,\u00a0fishing is a billion-dollar industry, with the country home to the\u00a0largest tuna fleet in the Pacific Ocean and the second biggest tuna industry in the world.<\/p>\n<p style=\"text-align: justify;\">But fishers, who regularly change vessels and have contracts issued for each trip \u2013 which usually last 20-40 days \u2013 are classed as self-employed. This means that workers in the wild-capture tuna fleet in Manta have been unable to establish their union \u2013\u00a0the\u00a0<em>Sindicato de Marineros de Manabi \u2013\u00a0<\/em>despite years of trying.<\/p>\n<p style=\"text-align: justify;\">Worse still, fishing is classed as one of the world\u2019s most\u00a0<a href=\"https:\/\/thefishingdaily.com\/latest-news\/fishing-revealed-as-worlds-most-dangerous-industry\/\">dangerous<\/a>\u00a0industries. Only two weeks before the Geneva meeting, four fishers died in a vessel fire in Manta, while a vessel observer was killed in April in a trawler collision.<\/p>\n<p style=\"text-align: justify;\">\u201cThese fishers need and deserve a union to be able to bargain collectively &#8211; at the most appropriate level suitable to this most particular industry,\u201d ITF Legal Director,\u00a0<strong>Ruwan Subasinghe<\/strong>, told the Committee.<\/p>\n<p style=\"text-align: justify;\">\n<h3 style=\"text-align: justify;\"><strong>Eswatini: Quash convictions, drop charges against trade unionists<\/strong><\/h3>\n<p style=\"text-align: justify;\">In an emotional intervention, ITF Legal Director\u00a0<strong>Ruwan Subasinghe<\/strong>\u00a0explained that he was sat behind the wife of trade union lawyer,\u00a0<a href=\"https:\/\/www.nytimes.com\/2023\/01\/28\/world\/africa\/eswatini-maseko-killed-lawyer.html\">Thulani Maseko<\/a>, when she came to the ILC in 2015 to appeal for his release from jail.<\/p>\n<p style=\"text-align: justify;\">Maseko was jailed for two years for speaking out on the injustices a worker faced in Eswatini\u2019s judicial system. He was eventually released in 2017 after serving his full sentence \u2013 but Maseko was shot dead in his house last year in what is believed to be a political killing.<\/p>\n<p style=\"text-align: justify;\">The dire situation faced by trade unionists in Eswatini, and the failure to uphold Convention 87 (<a href=\"https:\/\/normlex.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:12100:0::NO::P12100_INSTRUMENT_ID:312232\">C087<\/a>) on Freedom of Association and Protection of the Right to Organise, sadly continues.<\/p>\n<p style=\"text-align: justify;\">At the end of 2022, ITF-affiliate, the Swaziland Transport, Communication and Allied Workers\u2019 Union (SWATCAWU) called a \u201cjob stay away\u201d with demands to improve working conditions and to release jailed political leaders. Only a few weeks later, SWATCAWU General Secretary,\u00a0<a href=\"https:\/\/www.ituc-csi.org\/eswatini\">Sticks Nkambule<\/a>, survived an assassination attempt. The next day, heavily armed state forces raided his home and village.<\/p>\n<p style=\"text-align: justify;\">Fortunately, Nkambule escaped, but he has been in exile ever since, with the\u00a0SWATCAWU office now under constant surveillance and subject to regular forced entry from armed police.<\/p>\n<p style=\"text-align: justify;\">\u201cThis is no way for trade unionists to conduct their activities in full freedom,\u201d Subasinghe<strong>\u00a0<\/strong>said.<\/p>\n<p style=\"text-align: justify;\">\u201cThe Government of Eswatini must refrain from the violent treatment and harassment, including judicial harassment, of trade unionists.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>The consensual conclusions adopted by the Committee in this case called on the Government to drop all charges against Nkambule and to ensure his safe return home from exile.\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<h3 style=\"text-align: justify;\"><strong>Philippines: a culture of impunity for extrajudicial killings and enforced disappearances<\/strong><\/h3>\n<p style=\"text-align: justify;\">Speaking to Conference Committee on the Application of Standards on behalf of\u00a0<a href=\"https:\/\/www.bwint.org\/\">Building and Woodworkers International<\/a>\u00a0(BWI), the International Transport Workers\u2019 Federation (ITF), and\u00a0<a href=\"https:\/\/www.industriall-union.org\/\">IndustriALL<\/a>, BWI General Secretary\u00a0<strong>Ambet Yuson<\/strong>\u00a0outlined the continuing failure to realise Freedom of Association and Protection of the Right to Organise (ILO Convention 87,\u00a0<a href=\"https:\/\/normlex.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:12100:0::NO::P12100_INSTRUMENT_ID:312232\">C087<\/a>) in the Philippines.<\/p>\n<p style=\"text-align: justify;\">Yuson said he wanted to explain, \u201cthe risks my brothers and sisters back home face from being a trade unionist\u201d, including a number of cases which occurred after an ILO visit to the country. In 2023, the ILO dispatched a \u2018High-Level Tripartite Mission\u2019 (HLTM) to the\u00a0Philippines \u2013 missions are made up of governments, employers and workers\u2019 groups, and they investigate violations of international labour standards and labour rights.<\/p>\n<p style=\"text-align: justify;\">Yuson said that since the Mission, 24 trade union leaders are still jailed \u201con trumped-up charges\u201d, two of whom were arrested after the Mission. There have also been three new cases of abduction or enforced disappearance, while a large number of representatives from sectoral trade unions and labour movement campaign organisation,\u00a0<a href=\"https:\/\/sentrolabor.wordpress.com\/contact\/\">SENTRO<\/a>\u00a0(Sentro ng mga Nagkakaisa at Progresibong Manggagawa), are subject to ongoing \u2018<a href=\"https:\/\/www.rappler.com\/topic\/red-tagging\/\">red-tagging<\/a>\u2019, surveillance and profiling.<\/p>\n<p style=\"text-align: justify;\">Yuson explained that since the Duterte regime took office in 2016 \u2013 sparking a surge in red-tagging and extrajudicial killings \u2013 72 trade unionists have been killed.<\/p>\n<p style=\"text-align: justify;\">\u201cI cannot make this intervention without restating their stories,\u201d Yuson said. \u00a0\u201c<a href=\"https:\/\/uniglobalunion.org\/news\/uni-mourns-horrific-loss-of-alex-dolorosa-bien-organizer-in-the-philippines\/\">Alex Dolorosa<\/a>\u00a0was reported missing in April 2023, and his body was later found days later with multiple stab wounds.\u00a0<a href=\"https:\/\/www.solidaritycenter.org\/statement-solidarity-center-condemns-killing-of-union-leader-jude-thaddeus-fernandez\/\">Jude Thaddeus Fernandez<\/a>\u00a0was gunned down in September 2023.\u201d<\/p>\n<p style=\"text-align: justify;\">While killings have declined under the new Marcos administration, rogue state forces still operate under a culture of impunity.<\/p>\n<p style=\"text-align: justify;\">\u201cIt is imperative that the government immediately address and investigate the labour rights violations, as well as implement effective reforms to protect trade unionists in the country and all workers\u2019 right to organise,\u201d he said Yuson.<\/p>\n<p style=\"text-align: justify;\">\n<h3 style=\"text-align: justify;\"><strong>Tunisia: Collective bargaining restrictions affecting 40 trade unions<\/strong><\/h3>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\"><strong>Kemal \u00d6zkan<\/strong>, Assistant General Secretary of\u00a0<\/span><a href=\"https:\/\/www.industriall-union.org\/\"><span lang=\"EN-US\" xml:lang=\"EN-US\">IndustriALL<\/span><\/a><span lang=\"EN-US\" xml:lang=\"EN-US\">, spoke to the International Labour Conference Committee about workers\u2019 rights abuses in Tunisia on behalf of IndusrtiALL, the International Transport Workers\u2019 Federation and Building and Woodworkers International.<\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\">\u201cIn Tunisia, union leaders face dismissals and transfers from jobs because of their union work,\u201d \u00d6zkan said. \u201cUnion leaders are subject to fabricated court cases because of their union activities, and some have been jailed. The case of brother Anis Kaabi from the transport sector, who spent 14 months in prison, is a blatant example of such violations.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\">UGTT<\/span><span lang=\"FR\" xml:lang=\"FR\">\u00a0(<\/span><a href=\"https:\/\/www.ituc-africa.org\/Union-Generale-Tunisienne-du.html\"><span lang=\"FR\" xml:lang=\"FR\">Union G\u00e9n\u00e9rale Tunisienne du Travai<\/span><\/a><span lang=\"FR\" xml:lang=\"FR\">\u00a0\u2013 Tunisian General Labour Union) is struggling to achieve genuine social dialogue and respect for freedom of association in Tunisia. However, since 2021, the Government of Tunisia<\/span>\u00a0has indirectly suspended the work of the National Council of Social Dialogue by failing to appoint its own representatives to the Council.<\/p>\n<p style=\"text-align: justify;\">Government circular Nr.20, issued in 2021, restricts collective bargaining for around 40 trade unions and prevents the implementation of agreements between unions and respective ministries.<\/p>\n<p style=\"text-align: justify;\">At the same time, the Government is unilaterally amending labour laws and excluding UGTT from discussions, while also cancelling concessions enshrined in international law that allow workers holding a trade union position to work full time for UGTT: trade unionists Tahar Berberi, Bassam Ben Treka and Mohamed Bedera have all been asked to pay huge financial compensation to the Government, with Berberi \u2013 a former IndustriALL vice-president \u2013 facing a trial and blocked from travelling abroad due to his union work.<\/p>\n<p style=\"text-align: justify;\">The Government crackdown has also targeted international trade unionists. European Trade Union Confederation (ETUC) General Secretary, Esther Lynch, was ordered to leave the country after protesting the trade union crackdown \u2013 she had travelled to Tunisia alongside other international union leaders to show solidarity to UGTT.<\/p>\n<p style=\"text-align: justify;\">These examples leave severe concerns about the failure of Tunisia to respect the\u00a0ILO Convention 87 (<a href=\"https:\/\/normlex.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:12100:0::NO::P12100_INSTRUMENT_ID:312232\">CO87<\/a>) on Freedom of Association and Protection of the Right to Organise, and Convention 98 (<a href=\"https:\/\/normlex.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:12100:0::NO::P12100_ILO_CODE:C098\">CO98<\/a>) on\u00a0<span lang=\"EN-US\" xml:lang=\"EN-US\">The Right to Organise and Collective Bargaining.<\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-US\" xml:lang=\"EN-US\">\u00d6zkan\u00a0said: \u201cWe call on the government of Tunisia to implement all the signed agreements between the government and the UGTT and social partners, end all forms of harassment of trade union leaders, respect the national and international agreements and well-established national practices on union representation.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\">\n<h3 style=\"text-align: justify;\"><strong>Turkey: Borusan dockers, chronic failure to protect workers from anti-union dismissals<\/strong><\/h3>\n<p style=\"text-align: justify;\">In March this year, Turkish union\u00a0<a href=\"https:\/\/limanis.org.tr\/web\/\">Liman-\u0130\u015f<\/a>\u00a0started organising at the port of Borusan, in the country\u2019s Bursa province. The organisers\u2019 efforts met with success &#8211; 85% of the port\u2019s workers joined the union.<\/p>\n<p style=\"text-align: justify;\">Only three weeks later, six workers were dismissed for the sole reason that they joined Liman-\u0130\u015f &#8211; in direct contradiction of\u00a0Convention 87 (<a href=\"https:\/\/normlex.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:12100:0::NO::P12100_INSTRUMENT_ID:312232\">C087<\/a>) on Freedom of Association and Protection of the Right to Organise.<\/p>\n<p style=\"text-align: justify;\">But after their union brothers and sisters organised a four-day work stoppage, the workers were reinstated, and the company \u2013 Borusan Logistics \u2013 vowed to stop blocking union organising.<\/p>\n<p style=\"text-align: justify;\">\u201cThis is when things deteriorated,\u201d International Transport Workers\u2019 Federation (ITF) Legal Director,<strong>\u00a0Ruwan Subasinghe<\/strong>, explained to the Committee. \u201cAlmost immediately, the employer began to threaten workers and demand that they resign their union membership.\u201d<\/p>\n<p style=\"text-align: justify;\">By the next month, May, 37 workers \u2013 all lead organisers or union contacts &#8211; were put on leave. Less than two weeks later, they were all sacked via SMS after refusing to resign their union membership \u2013 with the ITF coordinating global\u00a0<a href=\"https:\/\/www.itfglobal.org\/en\/news\/dockers-in-turkey-need-our-support\">solidarity<\/a>\u00a0action soon after.<\/p>\n<p style=\"text-align: justify;\">&#8220;These 37 workers and their families are only a fraction of the people affected by Turkey\u2019s longstanding failure to protect workers against anti-union dismissals in the private sector,\u201d said Subasinghe.<\/p>\n<p style=\"text-align: justify;\">\u201cTurkey must, as a matter of urgency, adopt effective and sufficiently dissuasive sanctions against anti-union dismissals and ensure that workers who have suffered such prejudice, including the 37 dockers, are entitled to reinstatement in employment and full compensation in financial terms.<\/p>\n<p style=\"text-align: justify;\">\u201cAdequate protections against anti-union dismissals are not only necessary to protect workers rights and their livelihoods, they are essential to ensure the very existence of trade unions.\u201d<\/p>\n<p>Source :
