{"id":20058,"date":"2026-02-17T21:19:26","date_gmt":"2026-02-17T20:19:26","guid":{"rendered":"https:\/\/maritimafrica.com\/en\/?p=20058"},"modified":"2026-02-19T21:21:47","modified_gmt":"2026-02-19T20:21:47","slug":"imo-welcomes-entry-into-force-of-the-beijing-convention","status":"publish","type":"post","link":"https:\/\/maritimafrica.com\/en\/imo-welcomes-entry-into-force-of-the-beijing-convention\/","title":{"rendered":"IMO welcomes entry into force of the Beijing Convention"},"content":{"rendered":"<p><a href=\"https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2026\/02\/Beijing-Convention04.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-20059\" src=\"https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2026\/02\/Beijing-Convention04.jpg\" alt=\"\" width=\"1000\" height=\"750\" srcset=\"https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2026\/02\/Beijing-Convention04.jpg 1000w, https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2026\/02\/Beijing-Convention04-300x225.jpg 300w, https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2026\/02\/Beijing-Convention04-768x576.jpg 768w, https:\/\/maritimafrica.com\/en\/wp-content\/uploads\/2026\/02\/Beijing-Convention04-720x540.jpg 720w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\" data-contrast=\"auto\">The\u00a0United Nations Convention on the International Effects of Judicial Sales of Ships, known as the\u00a0Beijing Convention\u00a0on the Judicial Sale of Ships,\u00a0which enters into\u00a0force on 17 February 2026,\u00a0creates a harmonized and simplified system for recognizing judicial sales of ships across borders, helping ensure smoother international trade.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<div style=\"text-align: justify;\">\n<p><span lang=\"EN-GB\" data-contrast=\"auto\">The\u00a0<\/span><a href=\"https:\/\/uncitral.un.org\/en\/judicialsaleofships?_gl=1%2axx869j%2a_ga%2aOTI5OTgxNzMwLjE3NjgyMzUwNDY.%2a_ga_TK9BQL5X7Z%2aczE3NjgyMzUwNDUkbzEkZzAkdDE3NjgyMzUwNDUkajYwJGwwJGgw\" target=\"_blank\" rel=\"noreferrer noopener\">Beijing Convention<\/a><span lang=\"EN-GB\" data-contrast=\"auto\">\u00a0was developed by the United Nations Commission on International Trade Law (<\/span><a href=\"https:\/\/uncitral.un.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">UNCITRAL<\/a><span lang=\"EN-GB\" data-contrast=\"auto\">)\u00a0and adopted by the UN General Assembly in 2022\u00a0to address the problem of bona fide new owners and those financing the purchase of vessels who, for instance, find themselves dealing with previous creditors laying claim to the ship as security for a loan.\u202f<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p><span lang=\"EN-GB\" data-contrast=\"auto\">Under the Convention, a judicial sale conducted in one State Party is recognized by all other Parties. This grants the purchaser a \u201cclean title,\u201d free from prior debts or maritime claims, and gives new owners confidence that their ship will not be arrested later in a foreign port.\u00a0To ensure transparency, each State where a sale occurs must issue a notice of judicial sale and, as\u00a0appropriate,\u00a0a certificate of judicial sale.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p><span lang=\"EN-GB\" data-contrast=\"auto\">IMO plays a key role in implementation by serving as the repository for these\u00a0instruments. They will be made publicly available through a dedicated module on the IMO\u2019s Global Integrated Shipping Information System (<\/span><a href=\"https:\/\/gisis.imo.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">GISIS<\/a><span lang=\"EN-GB\" data-contrast=\"auto\">) platform, allowing all stakeholders to easily access harmonized information on\u00a0notices and certificates of\u00a0judicial sales.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p><span lang=\"EN-GB\" data-contrast=\"auto\">Previously, judicial sales of ships were governed by domestic laws, which varied widely between States.\u00a0This\u00a0treaty therefore\u00a0represents\u00a0a significant modernization that will reduce risk and friction in vessel transactions. By reducing legal risks and removing uncertainty, it helps strengthen the ship market, supports\u00a0maximum\u00a0pricing\u00a0in the market\u00a0and\u00a0facilitates\u00a0smoother international trade.\u00a0<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<\/div>\n<div style=\"text-align: justify;\">\n<p><span lang=\"EN-GB\" data-contrast=\"auto\">The Convention applies when a judicial sale occurs in a State Party and the ship is physically within that State\u2019s territory at the time of the sale.
