Consilium<\/u><\/strong><\/a><strong>, examines both how foreign \ufb01shing operators are accessing and exploiting African \ufb02ag registries for their \ufb01shing vessels in pursuit of legal impunity, and how weaknesses in African \ufb02agging regimes attract this exploitation.<\/strong><\/span><\/p>\n<p id=\"viewer-d9j5o\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">The global fishing market is projected to be worth $194 billion by 2027, so there is ample \ufb01nancial reward to be gained by \ufb01shing illegally. High-risk \ufb01shing vessel owners &#8211; those operations that are most likely to engage in illegal, unreported, and unregulated (IUU) \ufb01shing, unsustainable and\/or destructive \ufb01shing practices, and\/or those involving broader forms of associated crimes &#8211; are looking to create a situation where they can harness the resources of a State without any meaningful restrictions or management oversight. <\/span><\/p>\n<p id=\"viewer-3rlc7\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">Challenges with maritime governance and limited \ufb01sheries enforcement capacity across the continent of Africa, combined with the relative health of African \ufb01sheries, makes the continent an ideal venue for high-risk \ufb01shing operators to test a variety of tactics for evading accountability. Recognizing this phenomenon is a critical \ufb01rst step in discerning what can be done about it.<\/span><\/p>\n<p id=\"viewer-8364o\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">While concerns have been raised and discussed for many years about the \u2018genuine link\u2019 between the \ufb02ag state and the bene\ufb01cial owners and\/or operators of vessels, broader \ufb02ag-related concerns continue to emerge around \ufb01shing vessels that indicate a growing relationship between the \ufb02ag of the vessel and high-risk \ufb01shing practices. Both these processes a\ufb00ord high-risk foreign \ufb01shing operators the opportunity to more easily \ufb01sh illegally and unsustainably, which in turn undermines the sovereign rights of coastal African States.<\/span><\/p>\n<p id=\"viewer-9vo5p\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">The report identifies that the majority of African coastal States have flagged fishing vessels that have gone on to conduct illegal fishing activities, as identified through IUU listings or domestic information sources. Several case studies are provided that offer insight into how high-risk fishing operators are benefitting from their access to African flags.<\/span><\/p>\n<p id=\"viewer-fc8ik\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">As Africa turns to face ever increasing challenges in the maritime domain, ensuring that high-risk fishing operations and vessels are excluded from national flags is a critical step to securing the waters of Africa for the legitimate and sustainable enrichment of coastal States. <\/span><\/p>\n<p id=\"viewer-eq089\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">The good news is that for any State facing these challenges and that cares about its sovereignty and reputation, there are several ways to curtail opportunities for high-risk actors to appropriate and subsequently misuse its \ufb02ag, including:<\/span><\/p>\n<ul class=\"public-DraftStyleDefault-ul\" style=\"text-align: justify;\">\n<li id=\"viewer-5c2gg\" class=\"iWv3d xVLwT _3Kjjs public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr fixed-tab-size public-DraftStyleDefault-reset _1FoOD _3M0Fe aujbK iWv3d\">\n<p class=\"_1j-51 _1FoOD _3M0Fe aujbK iWv3d\"><span style=\"color: #1c1c87;\">Ensuring an inter-agency approach is taken on all \ufb01shing vessel \ufb02agging decisions is crucial to ensuring that vessels that are \ufb02agged can be e\ufb00ectively managed, receive proper oversight, and can be incorporated into national \ufb01sheries management plans.<\/span><\/p>\n<\/li>\n<li id=\"viewer-d05ua\" class=\"iWv3d xVLwT _3Kjjs public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr fixed-tab-size _1FoOD _3M0Fe aujbK iWv3d\">\n<p class=\"_1j-51 _1FoOD _3M0Fe aujbK iWv3d\"><span style=\"color: #1c1c87;\">Ensuring that effective due diligence is carried out on all flagging applications.<\/span><\/p>\n<\/li>\n<li id=\"viewer-d905e\" class=\"iWv3d xVLwT _3Kjjs public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr fixed-tab-size _1FoOD _3M0Fe aujbK iWv3d\">\n<p class=\"_1j-51 _1FoOD _3M0Fe aujbK iWv3d\"><span style=\"color: #1c1c87;\">Closing open vessel registries to \ufb01shing vessels.<\/span><\/p>\n<\/li>\n<li id=\"viewer-8q3d9\" class=\"iWv3d xVLwT _3Kjjs public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr fixed-tab-size _1FoOD _3M0Fe aujbK iWv3d\">\n<p class=\"_1j-51 _1FoOD _3M0Fe aujbK iWv3d\"><span style=\"color: #1c1c87;\">Strengthening oversight of private company involvement in open vessel registries as many of the private companies that manage open registries are entitled to make decisions without any or very limited consultation with the actual \ufb02ag state.<\/span><\/p>\n<\/li>\n<li id=\"viewer-538hi\" class=\"iWv3d xVLwT _3Kjjs public-DraftStyleDefault-unorderedListItem public-DraftStyleDefault-depth0 public-DraftStyleDefault-list-ltr fixed-tab-size _1FoOD _3M0Fe aujbK iWv3d\">\n<p class=\"_1j-51 _1FoOD _3M0Fe aujbK iWv3d\"><span style=\"color: #1c1c87;\">De-\ufb02agging bad actors to avoid reputational harm and to show a commitment to the rule of law. While African States can exert control over their own open vessel registries, only an international e\ufb00ort will help to curtail the use of foreign open vessel registries to facilitate the conduct of IUU \ufb01shing operations in Africa and beyond.<\/span><\/p>\n<blockquote>\n<p id=\"viewer-2diq8\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">Duncan Copeland, Executive Director TMT \u201cEvery fishing vessel needs to have a flag, and every flag State needs to effectively manage those fishing vessels. Ensuring that high-risk fishing operators and vessels cannot enter a flag registry or fishing grounds is one of the simplest and cost-effective steps that any nation can take to reduce the risk of illegal fishing, unsustainable fishing practices, and reputational damage. Individual countries and the international community have the opportunity to close flagging loopholes that currently contribute to illegal and unsustainable fishing practices in Africa and globally.\u2019<\/span><\/p>\n<\/blockquote>\n<blockquote>\n<p id=\"viewer-40bnh\" class=\"mm8Nw _1j-51 iWv3d _1FoOD _3M0Fe aujbK iWv3d public-DraftStyleDefault-block-depth0 fixed-tab-size public-DraftStyleDefault-text-ltr\" style=\"text-align: justify;\"><span class=\"_2PHJq public-DraftStyleDefault-ltr\">Dr. Ian Ralby, CEO, I.R. Consilium \u201cBeyond all the esoteric law and odd nuances of maritime matters, the flagging of fishing vessels is a fundamental issue of sovereignty. African states should have exclusive control over the resources within their own territory, and full control over how foreign entities may use their name and reputation to interfere with the resources of other countries. While this is a growing problem amid an already lengthy list of maritime governance challenges facing the African continent, it is a problem that can be solved with sufficient will and the consistent, determined implementation of good practices. There is likely no continent that suffers more from the deleterious effects of IUU fishing \u2013 on food security, food sovereignty, marine environmental sustainability, and the rule of law \u2013than Africa.
